By reaffirming Bitcoin’s standing as a decentralized digital commodity, the U.S. SEC framework removes key regulatory barriers, and potential price targets of $150,000 by 2026.
As previously reported in 2023 by Crypto News Flash (CNF), the U.S. SEC crypto regulatory landscape has entered a new chapter, with the Securities and Exchange Commission (SEC) taking in the center stage in shaping digital asset oversight.
At the Federal Reserve Bank of Philadelphia’s Fintech Conference, SEC Chair Paul S. Atkins announced a comprehensive planning to establish a “token taxonomy” framework, marking it as one of the most ambitious efforts yet to clarify how cryptocurrencies fit into existing financial laws.
Rooted in the historic 1946 Supreme Court case SEC v. W.J. Howey Co., this framework seeks to define when a digital asset qualify as a security and when it evolves with something else entirely. In his remarks, Atkins highlighted the need for a modern approach that acknowledges crypto’s evolution:
We are at the threshold of a new era in the history of our markets… Our regulatory framework need not be anchored to an analog past — unkind to new frontiers.
The Howey Test remains the SEC’s main yardstick for determining whether an asset is an investment contract, focusing on four elements such as (1) an investment of money, (2) in a common enterprise, (3) with an expectation of profit, (4) derived primarily from others’ efforts.
Furthermore, Atkins’ new taxonomy would retain this legal foundation but also apply “limiting principles” to reflect the decentralized and rapidly changing nature of crypto markets. Atkins said,
Cryptocurrencies may be part of an investment contract, but that doesn’t mean they will remain so forever,
This initiative underscores the SEC’s shifting role — from enforcement-heavy regulation under previous leadership to a more structured, principle-based approach that provides clarity without stifling innovation.
The SEC’s proposed token taxonomy carries profoundly bullish implications for Bitcoin, establishing it as the benchmark “digital commodity” once decentralization removing its securities status. By clarifying of boundaries and reducing ambiguity, the Commission’s efforts could encourage greater trust among institutional investors who have hesitated under the previous regulatory fog. As Atkins affirmed:
Markets channel human ingenuity toward society’s most intractable problems by rewarding those who develop the most innovative solutions that others value enough to buy.
With clearer definitions and reducing enforcement risks, trillions in institutional capital — particularly from pension funds, asset managers, and sovereign wealth funds — could re-enter the market. The effect could mirror the 2024 ETF approval surge, which pushed BTC prices over 60%.
Near-term expectations suggest a 10-20% rise as markets adjust, with longer-term potential pointing toward $150,000 by mid-2026 as global regulation aligns with this framework.
