Prior to trial, both parents resided in Dripping Springs, Texas, and exercised an equal possession schedule. Despite this arrangement, the jury awarded the father the exclusive right to designate the child’s primary residence within Hays County and counties contiguous with Hays County. Both parties sought adultery findings against one another; however, the jury determined that only the wife committed adultery.
Following the jury’s decision, the trial judge entered orders consistent with the verdict and granted the father the exclusive right to enroll the child in school, deferring to the jury’s determination regarding primary residence. The judge also ordered the mother to pay child support to the father.
