The policy of “continuous vetting” means that any individual with permission to be in the United States is now subject to ongoing scrutiny. For those currently in the U.S., this would trigger removal proceedings.

The scale of this review is unprecedented. The 55 million figure encompasses not only the millions of individuals presently in the U.S. on temporary visas or holding green cards but also those outside the country with valid, multiple-entry visas. This means that a tourist from India or China who has previously visited the U.S. and plans to return could have their visa invalidated before they book their flight, based on new information uncovered by authorities.

The mechanisms for this vetting are extensive. Officials will employ new data collection tools to scour law enforcement records, immigration history and – perhaps most notably – the social media accounts of visa holders. Violations such as unauthorized employment, dropping below a full course load or even minor infractions like a DUI arrest – which the State Department cited as a leading cause for recent revocations – could now result not just in expulsion but in a lifetime ban from re-entry.

The future for those on work visas, such as the H-1B for specialized occupations, is also now clouded with uncertainty. The administration’s parallel move to immediately halt the issuance of work visas for commercial truck drivers exemplifies a broader strategy to discourage American employers from relying on foreign labor.

Secretary of State Marco Rubio stated that the change protects American jobs and lives. However, industry analysts warn that it could also exacerbate existing labor shortages and disrupt supply chains. Policy analysts have suggested that the underlying goal is to create a climate of risk for U.S. companies, universities and hospitals that employ or enroll foreign nationals.

The threat of a sudden visa revocation makes hiring or retaining foreign talent a potentially unstable investment. This could lead to a “chilling effect,” where institutions become hesitant to navigate the complex visa process, ultimately pushing global talent to competitor nations like Canada and Australia.
