
TULSA, OKLA. (KTUL) — A second suspect has been charged in a 2019 shooting that left a man dead at a South Tulsa apartment.
Tulsa Police homicide detectives identified 24-year-old Devyn Smith as a suspect in the death of Benjamin Montgomery, 22.
On Oct. 10, 2019, officers responded to an apartment near 101st and Sheridan for a shooting.
Montgomery was shot in the chest and taken to the hospital, where he died a short time later.
The investigation revealed two male suspects were trying to rob another man, known to sell drugs, in the parking lot. The suspects forced the drug dealer upstairs to his apartment, but ended up entering the apartment next door.
Montgomery was inside the apartment with several of his friends and tackled one of the suspects in defense. He was shot in the process. The suspects fled.
In July 2025, a witness provided information that led to the arrest of Jerrell Jones, who was charged with first-degree felony murder in the case.
Detectives spent years following leads in this case, and in early July of 2025, a witness provided information identifying Jones as a suspect in the homicide. He is currently being held in the Tulsa County Jail on $1 million bond.
Smith was identified as the second suspect through multiple interviews and a deeper investigation, according to TPD.
He has been incarcerated in the Great Plains Correction Facility in Hinton, Oklahoma, since June 2022, currently serving a 10-year sentence for convictions involving firearms and assault and battery.
At this time, homicide detectives are still investigating this case.
