SEC just put the brakes on the wildest ETF idea yet: Canary’s PENGU fund, blending Solana meme PENGU with signature NFTs.
The U.S. Securities and Exchange Commission has again pushed back a decision on Canary Capital’s proposed Pudgy Penguins “PENGU” ETF, a niche filing that would give public-market investors exposure tied to a Solana meme coin and the Pudgy Penguins NFT brand.
The delay, disclosed in an SEC notice, keeps the product in regulatory limbo and underscores how even in a maturing crypto ETF landscape, the Commission is still moving deliberately on the most experimental structures.
What’s Delayed For Pudgy Penguins
Canary’s proposal stands out because it blends two volatile corners of the market: a meme coin (PENGU) and NFTs associated with the Pudgy Penguins ecosystem. That combination tests the boundaries of what an ETF wrapper can credibly hold or reference, and how investor protections would work in practice.
The SEC did not signal approval or rejection in the delay notice, but the extra time effectively postpones a market test of whether there’s durable demand for themed crypto exposure beyond the majors.

In a separate filing, Bitwise also set a launch date for a Chainlink-focused ETF intended to trade under ticker “CLNK” on NYSE Arca, after an auto-effective path to listing.
Meanwhile, Grayscale has taken early steps toward potential ETFs tied to BNB and Hyperliquid’s HYPE by registering statutory trusts in Delaware — a common precursor before a formal SEC submission. Those moves suggest issuers see the regulatory window as open enough to justify building inventory, even if approvals come slowly and unevenly.
Why This Matters
For investors, delays like Canary’s are less about one product and more about the SEC’s risk appetite. The nearer an ETF gets to meme coins, NFTs, or very young tokens, the more likely it is to face extended review — or a quiet fade-out if sponsors decide timing isn’t worth the effort.
