Notice of violation issued to Seneca County landfill for ‘noncompliance issues’

SENECA COUNTY, Ohio — A notice of violation was issued this week to WIN Waste Innovations of Seneca County for “ongoing noncompliance issues,” the Seneca County General Health District said Friday.

According to the health department, the noncompliance issues include:

The health department said the violations were found by SCGHD inspectors during inspections spanning from January through July.

“WIN Waste must now submit a written corrective plan within 7 days of the issuance of the violation that details the steps that will be taken to prevent the recurrence of the violations,” the health department said in a press release.

WIN Waste provided WTOL 11 with letters of compliance from the Ohio Environmental Protection Agency for inspections done from February through July.

According to the letters, the inspections were done to determine compliance with the state’s laws and regulations, and the facility’s permit, license and orders.

WIN Waste said 88 inspections were done at the landfill, and the letters state “no violations were discovered during these inspections.”

Part of a letter from the Ohio EPA dated Aug. 6 for July inspections reads:

“Ohio EPA’s Division of Materials and Waste Management (DMWM), Division of Surface Water (DSW) or Division of Air Pollution Control (DAPC) staff were present during the six inspections. DMWM inspected facility operations, including rail waste offloading, daily cover, construction activities, and maintenance of engineered components. DAPC inspected the gas treatment building plant and conducted an odor survey. DSW observed sampling required by the facility’s NPDES permit and inspected stormwater controls.

DAPC also performed five visits for maintenance of offsite air monitoring equipment. No violations were discovered during these inspections. Please be advised that this notice of compliance is only associated with those areas of the operations that were inspected and documentation reviewed.”

WIN Waste provided the following statement on Friday to WTOL 11:

“WIN Waste is proud of its proven environmental compliance track record, and it is deeply discouraging to see our facility unfairly targeted by local officials. Rather than focusing on improving health outcomes for Seneca County residents, the Board is using its authority to manufacture fear through press releases and allegations that lack legal and technical merit — costing residents hundreds of thousands of dollars that should be used to address real health issues in the County.

The inspections referenced in the NOV were conducted by individuals who lack the required Registered Environmental Health Specialist (REHS) certification, appropriate training, and any semblance of relevant Ohio regulatory experience. The health department’s lack of appropriate certifications is the only violation of law in this situation.

The Seneca County General Health Department’s (SCGHD) inspections and interpretations of Ohio EPA rules are factually deficient, technically unsound, and inconsistent with the uniform statewide application of solid waste regulations.

Importantly, the Ohio Environmental Protection Agency (OEPA) has conducted 88 inspections at our site in 2025 and continues to affirm our compliance. Bottom line: the SCGHD has chosen to stick their heads in the sand, ignore the expertise and findings of OEPA, and rely instead on the advice of biased and unqualified third parties.
