
The jury in Karen Read’s retrial came back with three questions for Judge Beverly Cannone on Tuesday morning.
Jurors asked what the “timeframe” was for Read’s operating under the influence charge.
“OUI at 12:45 [a.m.] or OUI at 5 a.m.?” Cannone read from the jury note.
The second question asked how they could consider Read’s interviews and whether they were evidence.
Lastly, jurors asked if convicting Read of a lesser included offense required the jury to convict her of the “overall charge.” Jurors specifically cited the 5th lesser included, operating under the influence, of the second count Read faces.
Cannone said she would hear from the lawyers on the first two questions, but confirmed the video clips were in evidence. The judge gave both sides 20 minutes to determine how they wanted to address the questions.
Before jurors entered, Cannone called the lawyers to a sidebar. After the conference, Read smiled at her father and David Yannetti, one of her attorneys, delivered the news to her supporters. One woman sitting with her parents began crying.
Read, 45, is charged with second-degree murder, manslaughter while operating under the influence and leaving the scene of an accident causing injury or death.
She is accused of ramming her Lexus SUV into her boyfriend, Boston Police officer John O’Keefe, outside the Canton home of another officer. Read and her lawyers have said she was framed and O’Keefe was beaten to death inside the home.
