
TUSCALOOSA, Ala. (WBRC) – A Tuscaloosa County Circuit Judge says he will need more time for examination before he decides whether to recuse himself in a capital murder case involving former Alabama basketball player Darius Miles.
Miles is charged in the shooting death of mother Jamea Harris on the Tuscaloosa Strip in 2023.
Miles’ legal team filed a motion Thursday asking Judge Daniel Pruet to recuse himself, claiming the judge has shown bias and prejudice in court proceedings for their client.
Defense Attorney Mary Turner said during a motion hearing Friday that Miles is no longer playing the game of basketball, he’s now fighting for his life.
In court filings, Miles’ attorneys allege Pruett has interrupted them no less than five times during arguments and given prosecutors more time. They also claim the judge has made comments on whether what Miles says is credible, saying he is being “picked on.”
Judge Pruet during Friday’s hearing said he’s not biased or prejudiced, but that he wants to examine the allegations of perceived bias and prejudice before he makes a final decision on whether he’ll recuse himself from the case.
“Perceived bias too must be considered,” Judge Pruet said.
WBRC asked when a final decision could be expected, Judge Pruett says he doesn’t have an immediate date.
Judge Pruet and Miles’ legal team both declined requests for interviews following the hearing.
Miles’ father, David, also declined an on camera interview but told WBRC that he considers Friday’s hearing a ‘small victory’. He also says his son is remaining hopeful and in good spirits.
State attorneys said Friday during the hearing that they trust Judge Pruet’s judgement.
